PUBLIC NOTICE NO. 139 /2017
Sub : Submission of reply to the queries raised by the officers for the purpose of
assessment – reg.
Attention of the all stake holders, importer, exporter, Custom Brokers and all concerned are invited to the provision of Section 17(3) of Custom Act, 1962 as reproduced below:
Section 17(3): “For verification of self-assessment under sub-section (2), the proper officer may
require the importer, exporter or any other person to produce any document or information, whereby the
duty leviable on the imported goods or export goods, as the case may be, can be ascertained and thereupon,
the importer, exporter or such other person shall produce such document or furnish such information.”

In terms of the above provisions the proper officer may raise query to obtain
information/documents for the proper assessment of goods. It is represented by the trade in the
PTFC meeting that CMC is not accepting the reply to the queries without signatures of the
Appraising Officers concerned, which delays filing of documents on part of trade.

The
above
request
of
the
trade
has
been
examined
and
the
following
procedures/guidelines are being prescribed in respect of the reply to the query to be submitted
by the importers/exporters:
(i)
In case where the query has been raised for submitting the requisite documents
including literature/catalogue or samples for the purpose of assessment, the query reply will
require the signature of the officer who has raised the query.
(ii)
In all other cases, the stake holder may submit the query reply to CMC through their
duly authorized representative. However, it would be imperative on the stakeholder to ensure
that the reply specifically addresses the query so as to obviate the need for further query. At the
same time, the officers are also directed to avoid the raising of piece-meal queries.
4.
Action to be taken in terms of decisions taken in this Public Notice should be considered
as standing order for the purpose of offices and staff.
5.
Difficulties, if any, in the implementation of the order may be brought to the notice of
the undersigned.
