PUBLISHED IN THE GAZETTE OF INDIA EXTRAORDINARY  (PART­1, SECTION­1)   GOVERNMENT OF INDIA MINISTRY OF COMMERCE     PUBLIC NOTICE NO. 16     (RE­00)/1997­2002 NEW DELHI ,  the    30th    June,2000                       In exercise of powers conferred under Paragraph 4.11 of the Export and Import Policy 1997­2002,  as notified in the Gazette of India extraordinary, Part­II­Section 3 – Sub­ section (ii) vide S.O.No.283(E) dated 31.3.97, the Director General of Foreign Trade hereby makes the following amendment in Handbook (Vol.1). (RE­00), 1997­2002.   1.     The following shall be added as paragraph 7.50A   7.50A Re­export of goods imported under DEPB scheme Goods  imported  under  DEPB  scheme,  which are found defective or unfit for use, may be re­ exported,  as  per  the  guidelines  issued  by  the Department of Revenue. In such cases 98% of the credit amount debited against DEPB for the export of such goods, shall be generated by the concerned  Commissioner  of  Customs  in  the form  of  a  Certificate,  containing  the  amount generated    and  the  details  of  the  original  DEPB. Based on the Certificate , a fresh DEPB shall  be  issued  by  the    concerned  Licensing Authority.  The  fresh  DEPB,  so  issued,  shall have the same port of registration and shall be valid  for  a  period  equivalent  to  the  balance period  of  validity  of  the  DEPB  against  which such goods were imported     2.       The following amendments shall be made in Chapter 10:   (a)            The first sentence of Paragraph 10.15 (ii) shall be amended to read as under:

“ The claim shall be filed against payment certificate received on monthly basis/quarterly basis/half yearly basis , except for supplies under paragraph 10.2 (d), (e),(f) and (g) , where it may be filed either on the basis of payment certificate or on the basis of proof of supplies effected.”   (b) The second sentence , beginning at the fifth line, of the Paragraph  10.15(ii) shall be deleted.   3.     The following amendment shall be made in Appendix 28A­   Product Group: Engineering (Product Code:61)   (i)    The value cap for DEPB entitlement as given in col.4 of the above Appendix shall be amended in respect of the following items as indicated against their respective entry numbers.     Sl. No DEPB entry No. Value Cap 1. 227 Rs. 55/­ Per Kg. 2. 300 Rs.75/­ Per Kg.          (ii)           Description of the export product at Sl.No. 407 shall be corrected to read as :  “Steel Ball made of mild steel/alloy steel/non­alloy steel”.   (iii)          Description of the export product at Sl.No. 483 shall be corrected to read as :  “Industrial roller/Motorcycle/Automotive Timing chain(all types including spares)”.     Product Group: Chemical (Product Code: 62)   (i)             The DEPB entry no. 573 shall be amended to read as under :   S.N. “Processed Cotton madeups  other than Grey namely bed spread/bed cover/pillow cases/pillow covers/mattress covers/sofa covers/quilt cover,  with or without  embroidery and/or with or without metallised yarn”.   (iii)           Description of the export product at Sl.No. 72 shall be corrected to read as under : “ All processed Cotton madeups including quilted cotton madeups, with or without  embroidery and/or with or without metallised yarn and not covered under Sl.No.69”.   (iv)          The following new DEPB entries shall be added after Sl.No.79         Sl.No Description DEPB rate Value Cap for DEPB entitlement   80   a)              furnishing fabric made out of dyed polyester filament yarn and dyed Cotton yarn width polyester content more than 50% by weight.   b)  Furnishing fabric made out of dyed polyester filament yarn and dyed cotton yarn with polyester content between 25% and 50% by weight.   10%                 10%     81 Dyed upholstry/furnishing fabrics made out of polyester filament yarn, viscose spun yarn and cotton yarn 10%     (v)           The description of the export product at Sl.No.44(a) shall be corrected to read as under :­
