MINUTES OF THE 11TH INTER MINISTERIAL COMMITTEE MEETING CONSTITUTED FOR RECOGNITION AND REVIEW OF PRE SHIPMENT INSPECTION AGENCY UNDER APPENDIX 5 OF HBP (Vol.I). Singh, Scientist AERB (iv) Shri D.C. Katoch, FTDO The Chairman welcomed the members of the Committee. It was brought to the notice of the Committee that all the 33 enlisted PSIA were given time limit upto 30th June 2013 for submission of purchase Invoice / delivery receipt / documents such as Calibration certificate to prove ownership of the equipment with serial number, failing which the cases may be reviewed for delisting from Appendix – 5, without any further intimation. The information has been received from these PSIA has been given in PartIII of the agenda. The agenda has been prepared in three parts: PartI Request for enlistment of agency PartII Cases in respect of location of PSIA not found, SCN were issued. PartIII Cases in respect of submission of purchase invoice / challan 2. The Committee after due deliberations took following decision in each case: PART I Request for enlistment of Agency Sl.No.Case No. Name of Applicant / File Number 1 33 American Quality Assessors India (P) Ltd., Hyderabad [01/53/162/774/PSIA/AM13/A44/IC] The Committee noted that the applicant has applied for recognition as PSIA for Iran and USA. They were asked to submit information in the format prescribed by AERB vide E Mail dated 9.10.2012, 14.11.2012, and 23.1.2013. They were also requested to furnish copy of purchase Challan / Invoice from the supplier vide E Mail dated 23.1.2013 and reminder dated 6.2.2013. The Committee further noted that the information provided by the firm vide letter dated 13.2.2013 did not pertain to purchase of hand held survey meter and spectrometer and they have also not furnished the requisite information of mandatory equipment in the AERB format, till
date despite various reminders dated 5.4.2013, 8.4.2013 & 9.5.2013, 27.5.2013 & 8.7.2013. 2. The Committee after due deliberations decided to defer the case. Last chance may be given to applicant to submit the technical details within a period of one month. The case will be placed before the Committee only after receipt of requisite information from the applicant. 2 34 Worldwide Inspection Services SARL, West Africa [01/53/162/162/AM13/W3/IC] The Committee noted that a Show cause notice has been issued to the firm on 21.8.2012 on receipt of complaint received from Customs that war material was found in one consignment imported by M/s M/M. Alloys, Gandhidham vide B/E No.6880412 dated 12.5.2012. The applicant replied that they have not issued any such PSIC and requested to provide a copy of the PSIC. A copy of the PSIC was then obtained from Customs and the firm was requested to provide a list of all PSIC issued by them during the period. The firm vide 31.5.2013 (submitted on 27.6.2013) has submitted the detailed list of PSIC issued by them from 1.1.12 to 23.9.212, which is being examined separately. The firm has replied that they have not issued the PSIC. 2. The Committee noted that since the case is under adjudication of DGFT and DRI(Customs), a decision can only be taken after the orders are passed in the matter. The Committee after due deliberations decided to defer the case and the case may be placed in Committee only after the orders are passed by adjudicating authority. 3 35 Inspectorate International Ltd., United Kingdom [01/53/162/775/AM13/PSIA/I17/IC] The Committee noted that the applicant has furnished the information of Red Alert Monitors with serial Numbers 005169, 005202, 005249, 005250 and 005268 in AERB format. Since, they do not have the purchase Invoice of these equipment, they have submitted the Calibration certificate of these equipments indicating their name as the owner of the equipment. 2. The representative of AERB informed that the applicant has now furnished the details of Portable Spectrometer in AERB format, which appears to be in order. 3. The Committee, after due deliberations decided to approve the firm as Pre Shipment Inspection Agency for England. 4 36 Geo Chem Inspection (Malaysia) SDN BHD, Malaysia [01/53/162/PSIA/AM13/G30/IC]
The Committee noted that the applicant has revised their request for approval as PSIA in Malaysia and Singapore stated their counterparts of the above countries do not have proper infrastructure / manpower and current market scenario are not supporting to develop the business. 2. The Committee noted that they have purchased the equipments having Sr. No. 312064, 312065, 312066 and 312069 from M/s.Geo Chem Singapore Pte Ltd, which has been recommended for delisted from the Appendix 5 for failing to perform their duty for prevention of import of radioactively contaminated metal scraps / materials. The problem could be due to machines / device failure including the purchased equipment. 3. The Committee, therefore, decided that the above equipments cannot be allowed for conducting a inspection of pre shipment. Therefore, the Committee decided to defer the case. 5 37 Bureau Veritas (India) P Ltd., Mumbai 01/53/8/504/AM13/PSIA/B33/IC The Committee noted that the applicant has applied for recognition as PSIA for India, Srilanka and Bangladesh. As per the information given in AERB format, they are having one Hand held Survey meter (Micro Rad – Make Pulse Cho System (Bombay) Pvt. Ltd., Sr. No.L3044, date of calibration is 13.2.2013. They also have One Portable Spectrometer {model XL3T 970 Model Analyzer Sr. No.62230}. 2. A clarification was also sought from the applicant that the energy range of Micro Rad Equipment indicated by the firm as 80 keV, whereas, as per the requirement, it should start from 60 keV. However, no reply has been received from them. 3. The Committee further observed that the applicant is not having any office in Srilanka and Bangladesh. The Committee after due deliberations decided that the request of the firm may not be accepted. 6 40 Novatech Inspection Services LLC, Dubai 01/5/8/69/AM14/PSIA/N5/IC The Committee noted that the firm has requested to grant them PSIA for Saudi Arabia, Bahrain, Qatar, Kuwait, Oman, Jordan, Yemen, USA, Mexico, Canada, Japan, Kenya Tanzania and Uganda with 15 portable Spectrometer
and 18 Hand held Survey Meter. In the last meeting, the request was approved for PSIA for Dubai. The applicant vide letter dated 2.8.2013 represented that UAE is the main liason office for the entire company, but the volume of business from the UAE alone in terms of scrap metal exported to India is very small and that there are already several PSIA operating in UAE. They requested to grant enlistment in all the applied countries on the basis of 15 portable spectrometer and 18 Handheld survey meter. 2. The representative of AERB present in the meeting confirmed that the equipment appears to be in order and they have also furnished copy of purchase invoice in respect of all these equipment. 3. The Committee after due deliberations decided to enlist the application as PSIA for Saudi Arabia, Bahrain, Qatar, Kuwait, Oman, Jordan, Yemen, USA, Mexico, Canada, Japan, Kenya Tanzania and Uganda subject to production of place specific equipment details, complete postal address of all territories along with PIN Code number, Phone number (landline), if any, so as to include these datails in the Public Notice. 7 41 Cotecna Inspection India Pvt. Ltd., 01/53/171/45/PSIA/AM14/C8/IC The Committee noted that the applicant firm has applied for recognition as PSIA in 38 territories / countries. They were asked to furnish information of Portable Spectrometer and Handheld Survey Meter in AERB format. 2. The firm is having only 02 numbers of Hand held survey meter having Sr. Nos. 30371 & 30394 and 01 number of Portable Spectrometer having Sr. No.2000053 in AERB format and submitted purchase orders of equipments and proof of payment. The representation of AERB present in the meeting informed that the details given by the applicant appears to be in order. However, on the basis of the available equipment, enlistment can be given only for one country / territory. 3. The Committee after due deliberations decided to approve the case as PSIA for one country / territory. However, the firm shall indicate the specific country / territory where the equipment would be placed alongwith the details of address phone number, FAX number etc. 8 42 Global Consortium for Inter Border Trade Inspection & Certification Ltd., 01/53/162/171/PSIA/AM14/G9/IC
The Committee noted that the applicant has applied for recognition as PSIA in (i) UK, (ii) North America, (iii) South Africa, (iv) GCC Region and (v) Singapore. They are having 05 MSpecPortable Radiation Spectrometer and Dose Rate Survey Meter having Sr. Nos. 20068 to 20072, as per information given in AERB format. 2. The applicant has been asked to procure more handheld Survey meters for applied locations / countries, as the present equipment would not be sufficient for inspection in these countries. 3. The applicant have procured five additional Hand held Survey Meter having Serial Number LK0000002265 to LK0000002269 and also furnished proforma / purchase invoices of these equipments. 4. The representative of AERB present in the meeting confirmed that the equipment appears to be in order. 3. The Committee after due deliberations decided to enlist the applicant as PSIA for (i) UK, (ii) North America, (iii) South Africa, (iv) UAE and (v) Singapore. 9 43 CWM Survey & Inspection, Netherlands 01/53/8/153/AM14/C13//IC The Committee noted that the applicant has filed revised application for recognition as PSIA in various countries with 06 numbers of Hand held Survey Meter having Serial Number 54740, 54754, 12344, 0137, 4138 andD723 and 01 number of Portable Spectrometer having Serial Number 11203536 and also furnished the proforma invoices of these equipments. 2. The representative of AERB present in the meeting confirmed that the equipment appears to be in order. However, on the basis of the available equipment, enlistment can be given only for one country / territory. 3. The Committee after due deliberations decided to approve the case as PSIA for one country / territory as European Union. 10 44 AL KHALIDIAH METAL TR. CO L.L.C., UAE 01/53/162/88/PSIA/AM14/A8/IC The Committee noted that as per the information given by the applicant in the AERB format, they are having 06 Portable Gama Spectrometer and
Radiation Survey Meter having Sr. Nos. 1540010 to 1540015. 2. The representative of AERB informed that the applicant is having only one tipe of equipment and they have indicated the details of these equipment in both the format prescribed by AERB for Portable Spectrometer as well as Handheld Survey Meter. 3. The Committee after due deliberations decided to defer the case and also decided that the applicant may be advised to purchase separate Hand held Survey Meter. 11 45 Trans Border Safety Control Inspection Services LLC, USA 01/53/162/191/PSIA/AM14/T6/IC The Committee noted that applicant has applied for recognition as PSIA in USA, South Africa, GCC, West Africa, and European Union. As per the information given by them in the AERB format, they are having 05 Portable Gama Spectrometer and Radiation Survey Meter having Sr. Nos. 200060 to 200064. They have also purchase 05 more hand held radiation survey meters having serial numbers F3510664, F3510665, F3510667, F3510668 and F35 10669. They have also submitted purchase invoices of the equipments. 3. The representative of AERB present in the meeting confirmed that the equipment appears to be in order. 3. The Committee after due deliberations decided to enlist the applicant as PSIA for (i) USA (ii) South Africa (iii) UAE,(Dubai) (iv) West Africa and (v) European Union. 12 46 M/s International Certification Service Pvt. Ltd., Mumbai 01/53/171/164/PSIA/AM14/I1/IC The Committee has noted that the applicant has applied for recognition as PSIA in India. However, they have not furnished the information of hand held Survey Meter and Portable Spectrometer in AERB format. They have also not furnished Purchase Invoice and delivery challan. 2. The Committee after due deliberations decided to seek the above details from the applicant. 13 47 M/s Nuage Inspection Services, Faridabad (Haryana)
01/53/171/170/PSIA/AM14/N6/IC The Committee has noted that the applicant has applied for recognition as PSIA in UAE. As per the information given by them in AERB format, they are having 05 numbers Radiometer RAD35 and 02 numbers of RAD Com having serial number 20068 and 20069. 2. They have not furnished the Purchase Invoices and delivery Challan of said equipments. 3. The Committee after due deliberations decided to seek the above details from the applicant. 14 48. M/s Baltic Inspection Centre, Latvija 01/53/162/328/PSIA/AM14/B1/IC The Committee has noted that the applicant has applied for recognition as PSIA in Latvija. However, they have not furnished the information of hand held Survey Meter and Portable Spectrometer in AERB format. They have also not furnished Purchase Invoice and delivery challan. 2. The Committee after due deliberations decided to seek the above details from the applicant. 15 49 M/s Ravi Energie INC, USA 01/53/171/183/PSIA/AM14/R1/IC The Committee has noted that the applicant has applied for inclusion of additional area / region for recognition as PSIA in (i) Mauritius (ii) Madagascar (iii) South Africa (iv) South Africa (v) Kenya (vi) Israel (vii) Jordan (viii) Lebanon (ix) Australia and (x) New Zealand. 2. As per the information given by the applicant, they are having 05 numbers GR135 Plus Spectrometer Kit W/HE3 having serial Number 9091, 9093, 9094, 9095 & 9096 and furnished the proforma invoices. 3. The representative of AERB informed that the applicant have indicated the details of Spectrometer only and they have not furnished Hand held survey meter. Self calibration mechanism need to be explained. 4. The Committee after due deliberations decided to seek the above details from the applicant.
16 50 M/s Ravi Energie INC, USA 01/53/162/366/PSIA/AM13/R13/IC The Committee has noted that applicant has requested to change the following region allocated their three group companies: Present Region Requested for re‐allocaៜ�on. South Korea Sri Lanka, India & Singapore UAE UAE, Saudi Arabia, Oman & Kuwait Brazil South Korea & Japan 2. The Committee after due deliberations decided that the request for change of country / territory would be considered after six month after consolidation of the present process. 17 51 M/s Gattini & Co., Mumbai 01/53/162/138/PSIA/AM13/G6/IC The firm has filed the application on 12.54.212 for recognition of PSIA in India. 2. As per the information given by the firm they have procured mandatory equipment having Serial Number 100298 & 200051 and also submitted Proforma invoices/challan. 3. The representative of AERB present in the meeting confirmed that the equipment appears to be in order and they have also furnished copy of purchase invoice in respect of all these equipment. 3. The Committee after due deliberations decided to enlist the application as PSIA subject to production of place specific equipment details, complete address of territories along with PIN Code number, E mail address, Phone number (landline), if any. The location needs to be outside India. PartII Cases where location of PSIA not able to be verified and hence SCN were issued. 18 9 M/s Sandeep Garg & Company SARL, Mali 01/53/162/PSIA/AM13/S50/IC Applicant was approved as PSIA for Mali, Benin, Ivory Coast, Cameroon, Gambia, Ghana, Liberia, Nigeria, Senegal, Sierra Leon, Guinea,
Togo and Morocco vide Public Notice No. 27 dated 19.10.2012. 2. It has been observed during verification that the address of the PSIA in Sierra Leon was not physically present in particular location. In reply to Show Cause Notice the firm has clarified that their Mali citizen can visit the 12 countries including Sierra Leon and they never declared any branch office in Sierra Leon. 3. The Committee has observed that in reply to Show Cause Notice, the firm has not submitted the AnnexureIII. 4. The Committee after due deliberation decided to seek AnnexureIII from the firm and process the case on file. 19 15 M/s Superintendence Company India (Pvt.) Ltd., Kolkata 01/53/162/276/PSIA/AM13/S30/IC Applicant was approved as PSIA for Singapore, UAE, Bangladesh and European Union vide Public Notice No.52 dated 28.3.2013. 2. It was observed that during the verification, the address of the PSIA in Bangladesh was not physically present in particular location. In reply to Show Cause Notice, the firm has clarified that their representative was not present during inspection at Bangladesh office and he might had gone out for inspection or any other work. 3. The Committee has observed that office address of Bangladesh is not their own office and it appears that they are working at some other office. It indicates lack of seriousness. 4. The Committee after due deliberation decided to process the case on file 20 20 M/s Geo Chem Middle East, UAE 01/53/162/769/PSIA/AM13/G23/IC The applicant was approved as PSIA for Russia, Bangladesh, UAE, Oman, Kuwait, European Union, USA and Australia vide Public Notice No.39 dated 18.12.2012. 2. It was observed that during the physical verification the PSIA in Bangladesh was not physically present at declared address. In reply to Show Cause Notice, the firm has clarified that address given by them in Bangladesh
was inadvertently typographical / human error and they had to mentioned 18/1, Naya Paltan instead of 1, Naya Paltan. 3. The Committee noted the lack of seriousness in conduct of business and after due deliberation decided to process the case on file. 21 30 M/s World Wide Logistic, Survey & Inspection, New Delhi 01/53/162/776/PSIA/AM13/W11/IC Applicant was approved as PSIA for Indonesia, European Union, Israel, South Korea, Bangladesh, Sri Lanka Mauritius, West Africa, and Japan vide Public Notice No.52 dated 28.3.2013. 2. It was observed during physical verification of the address of the PSIA in Israel and Bangladesh, the firm was not physically present in particular location. In reply to Show Cause Notice, the firm has clarified that during the time of inspection their representative may not be present in the Israel office at that particular. For Bangladesh, the firm has clarified that their representative in Bangladesh has changed his office premises from Janata Iron Market, Sagarika Road, Pahertali to Shop No.12, 4th Najir Saleh Complex, D.T. Road, Abdul Ali Hat, Pahertali. 3. The firm should have immediately notified DGFT about change of address, the Committee has observed that the clarification given by the firm is not justified and it has been decided that the PSIA of Bangladesh may be delisted. 22 32 M/s Controlex Limited, UAE 01/53/489/PSIA/AM13/C51/IC The applicant was approved as PSIA for Brazil, Canada, Djibouti, Egypt, Iran, Mozambique, Qatar, Saudi Arabia and Sudan vide Public Notice No.12 dated 8.5.2013. 2. It was observed during the verification that the address of the PSIA in Iran and Qatar was not physically present in particular location. In reply to Show Cause Notice, the firm has clarified that the address given by them in Iran and Qatar was inadvertently typographical / human error and they have furnished the complete address of Iran and Qatar. 3. The Committee has observed that the clarification given by the firm is not justified and it was decided that the PSIA of Iran and Qatar may be delisted.
PartIII Cases where complete purchase invoice / Challan has not been received from PSIAs. 23 7 M/s SGNCO (UK) Limited, London 01/53/162/617/PSIA/AM13/S52/IC Applicant was approved as PSIA for UK vide Public Notice No.20 dated 1.10.2012. 2. At the time filing the application, the firm had indicated Serial Number of equipment as 21521, 122217, 2369, 5781 and 903555135. After enlistment the firm has submitted Proforma invoices of equipments having Serial Number E0100844, E0100874, 18861, 5781 and 903555135 and submitted the calibration certificate of Serial Number 5781 claiming that it has been damaged and clarified that they have been using/shifting their all radiation check instruments in various countries for conducting inspection as and when required and at that it was ot mandatory to keep the equipment region was. They realised that some of instruments were either damaged or giving wrong reading. 3. The Committee after due deliberation decided to seek the further details of remaining equipment having serial number 21521, 122217, 2369 and 903555135 from the firm. 24 8 M/s Sandeep Garg & Co. Houston 01/53/162/616/PSIA/AM13/S51/IC The applicant was approved as PSIA for USA vide Public Notice No.20 dated 1.10.2012. 2. At the time filing the application, the firm had indicated Serial Number of equipment as 11/3/062, 122216, 2313, 2450, 903558 and 901383153. After enlistment the firm has submitted Proforma invoices of equipments having Serial Number 11/03/062, E0100872, 19955, 903555279 and 901383153 and clarified that they have been using/shifting their all radiation check instruments in various countries for conducting inspection as and when required and at that it was ot mandatory to keep the equipment region was. They realised that some of instruments were either damaged or giving wrong reading.
3. The Committee after due deliberation decided to seek the further details of remaining equipment having serial number 122216, 2313, 2450 and 90355 from the firm. 25 10 M/s Sandeep Garg & Co. Houston 01/53/162/614/PSIA/AM13/S49/IC The applicant was approved as PSIA for Canada vide Public Notice No.20 dated 1.10.2012. 2. At the time filing the application, the firm had indicated Serial Number of equipment as 09/12/070, 2308 and 903558127. After enlistment the firm has submitted Proforma invoices of equipments having Serial Number 09/12/070, E0100872 and 903558127and clarified that they have been using/shifting their all radiation check instruments in various countries for conducting inspection as and when required and at that it was ot mandatory to keep the equipment region was. They realised that some of instruments were either damaged or giving wrong reading. 3. The Committee after due deliberation decided to seek the further details of remaining equipment having serial number 2308 from the firm. 26 13 M/s Valueguru Chartered Engineers and Valuers Pvt. Ltd., Tamil Nadu 01/53/162/774/PSIA/AM13/A44/IC The applicant was approved as PSIA for India vide Public Notice No.38 dated 18.12.2012. 2. At the time of application, the firm had indicated serial number of Hand held Survey Meter as 4573930003 and serial number 9653 of Portable Spectrometer. After enlistment the firm has submitted Proforma invoices of equipments having Serial Number 30339 and 9728. 3. The firm was requested to clarify that why they have changed the serial number of the equipments. The firm has still not furnished the clarification. The Committee after due deliberation decided to defer the case for want of clarification from the firm & place the matter, which is serious, in next meeting. 27 14 M/s Sandeep Garg & Co. Gurgaon 01/53/162/614/PSIA/AM13/S49/IC The applicant was approved as PSIA for India, European Union, South Africa, Australia, New Zealand and Singapore vide public notice No.27 dated 19.10.2012.

After enlistment they have submitted Proforma invoices of equipment at item No. (1) to (10) and changed the serial number of equipment at item No. (17) to (28) and clarified that they have been using/shifting their all radiation check instruments in various countries for conducting inspection as and when required and at that it was ot mandatory to keep the equipment region was. They realised that some of instruments were either damaged or giving wrong reading. 3. The Committee after due deliberation decided that the firm may be advised to furnish the remaining Proforma invoices having serial number at item No. (17) to (28) and also seek the clarification why they changed the equipment having serial number at item No. (11) to (16). 28 19 M/s ELBI Consultancy (India) Pvt. Ltd., Kolkata 01/53/162/95/PSIA/AM13/E5/IC The applicant was approved as PSIA for India vide Public Notice No.20 dated 1.10.2012. At the time filing the application, the firm had indicated Serial Number of equipment as 26711 & 19874. After enlistment they have submitted Proforma invoices/challan for serial number 26711 and 61202 and clarified that due to malfunctioning the Spectrometer bearing Serial Number 19874 they have changed the machine with latest generation technology of the Spectrometer bearing Serial Number 61202 and they have not maintained the any records and have also returned the original documents of that purchase. The Committee after due deliberation decided to seek more details from the firm for change the equipment. The meeting ended with vote of thanks to the Chair. xxx
