MINUTES OF THE 9TH INTER MINISTERIAL COMMITTEE MEETING CONSTITUTED FOR RECOGNITION AND REVIEW OF PRE SHIPMENT INSPECTION AGENCY UNDER APPENDIX 5 OF HBP (Vol.I). Date : 10.05.2013 Venue : Room No.4, Udyog Bhawan, New Delhi Time : 11.00 a.m. Members present: (i) Shri D.K. Singh, IAS, Addl.DGFT (ii) Shri B.K. Singh, AERB (iii) Shri Hardeep Singh, Jt.DGFT (iv) Shri Rajesh Malhotra, Dy.DGFT (v) Shri D.C. Katoch, FTDO The Chairman welcomed the members of the Committee. It was brought to the notice of the Committee that till date 32 PSIAs have been approved as Pre Shipment Inspection Agency (PSIA). 2. The Committee noted that all the enlisted PSIA have been given extended time limit upto 31st May 2013 for submission of purchase Invoice / delivery receipt / Challan of the equipment to show ownership of the equipment with serial number. Otherwise the cases may be reviewed for delisting from Appendix – 5, without any further intimation. 3. The Committee also noted that a complaint has been received from AERB that M/s.GeoChem Far East Pte Ltd., Singapore had issued a Pre Shipment Inspection Certificate, after inspection of a few containers destined to M/s. Jindal Stainless Ltd., Hissar, India declaring that radiation level on the consignment was not more than the background radiation level. When AERB assessed the

MSK4188400 was found to be well above the background (90µR/h) confirming that the scrap is radioactively contaminated. The Committee was of the view that the PSIC was not correct and proper and is contrary to the declaration / undertaking given by the Inspection Agency. Therefore, Committee decided to immediately issue a SCN to M/s.GeoChem Far East Pte Ltd., Singapore as well as the importer M/s.Jindal Stainless Ltd., Hissar for taking action under para 2.32.2 B of Handbook of Procedure, Foreign Trade (Development and Regulation Act, 1992 and Foreign Trade (Regulations) Rules, 1993 and imposition of penalty. 4. The issue of ‘Experience’ in the field of Inspection of Metal Scrap was also discussed by the Committee. The Committee was of the view that the experience factor has not been taken into consideration while approving the applicants as PSIA to avoid monopoly in the field. Applicants fulfilling the criteria of having mandatory testing equipments and offices along with technical manpower at the area of operation may only be considered by the Committee.
5. The Committee after due deliberations took following decision in each case:

However, they have not furnished the requisite documents. The Committee, therefore, decided to defer the case for want of purchase invoice and delivery receipt / Challan of Handheld Survey Meters and Portable Spectrometer. 34 Worldwide Inspection Services SARL, West Africa [01/53/162/162/AM13/W3/IC] The Committee noted that a SCN has been issued to the firm on 21.8.2012. The firm has replied that they have not issued any such PSIC and requested to provide a copy of the PSIC. A copy of the PSIC was then obtained from Customs and the firm has been requested to provide a list of all PSIC issued by them during the period. However, reply from the firm is awaited. The Committee, therefore, decided to defer the case for want of reply from the firm. 2. In the meantime, the firm may be asked to submit Serial number of handheld survey meters and Portable Spectrometers in the AERB format,

However, the firm informed that since the majority of their equipment was purchased a number of years ago and their account also do not have old records, purchase invoice are not available with them which are more than 6 years old. However, they are holding calibration details for all the radiation monitors, which have to be calibrated on an annual basis by an external
company. Therefore, they have furnished calibration details for these radiation monitors. 2. The Committee further noted that the calibration certificate furnished by the applicant does not indicate name of the applicant. The Committee, therefore, decided to defer the case for want of corroborative evidence from the applicant to indicate ownership of the equipment. 36 Geo Chem Inspection (Malaysia) SDN BHD, Malaysia [01/53/162/PSIA/AM13/G30/IC] The Committee noted that the applicant was asked to furnish copy of purchase invoice and delivery receipt / Challan of Handheld Survey Meters

Therefore, clarification was sought from the firm in this regard. However, the reply from the firm was awaited. 2. The Committee after due deliberations decided to defer the case for want of clarification from the firm. 38 Global Mines and Minerals FZE, UAE (01/53/171/86/AM13/PSIA/G48/IC) The Committee noted that the applicant has filed the application for recognition as PSIA for Middle East (UAE). As per the information given by them, they are having 01 Hand held Survey Meters (Sr. No.20004) and 01 Portable Spectrometers (Sr. No.81) and have furnished the information in AERB format of the equipment. They have also submitted copy of 2 Invoices (dated 16.3.2013 & 19.3.2013) along with Challan No.CH807 & CH808 dated 16.3.2013 for these handheld survey meter and Portable spectrometer.

The representative of the AERB present in the meeting stated that photograph of Portable Spectrometers (Sr. No.81) is required for examination. The Committee also noted that the applicant has purchased
the equipment from M/s. International Consulting Company, India for their office at Dubai. 3. The Committee after due deliberations decided to defer the case for want of (i) photograph of Portable Spectrometers (Sr. No.81) and (ii) confirmation from the applicant to the effect that the equipment has reached its destination and is in possession of the company at UAE. 39 SNG Inspection Services, Noida (01/53/162/1065/AM13/S83/IC) The Committee noted that the applicant is already an approved PSIA for India. They have now filed the new application for enlistment as PSIA in Malaysia and Vietnam on the basis of 2 hand held survey meters and 2 portable spectrometer (Sl.No.20045 and 200027) and handheld Survey Meter (Sl.No.100202 and 100200). The representatives of AERB informed that the information furnished by the firm regarding the Handheld Survey Meter and Portable Spectrometer and other technical parameters appears to be in order. 2. As per the information given in AERB format, they have 15 Portable Spectrometer (MEDSpec Hand Held Gamma Spectrometer) and 18 Hand Held Survey Meter (Inspector Handheld Digital Radiation Alert Detector). They have also furnished Invoice in respect of Portable Spectrometer and Hand Held Survey Meter. However, they have not furnished photographs and delivery receipt / Challan. 2. The Committee after due deliberations decided to defer the case for want of photographs and delivery receipt / challan of all the testing equipment from the firm. 41 Cotecna Inspection India Pvt. Ltd., 01/53/171/45/PSIA/AM14/C8/IC The firm has filed the application for recognition as PSIA in 38 territories / countries. However, they have not furnished the information of Portable
