MINUTES OF THE 3rd INTER MINISTERIAL COMMITTEE MEETING CONSTITUTED FOR RECOGNITION AND REVIEW OF PRE­SHIPMENT INSPECTION AGENCY UNDER APPENDIX 5 OF HBP (Vol.­I).   Date           :         26.09.2012 Venue        :         Room No.4, Udyog Bhawan, New Delhi Time           :         10.30 a.m.   Members present:   (i)           Shri D.K. Singh, IAS, Addl.DGFT (ii)          Shri B.D. Ghosh, Addl. IA, Min. of Steel (iii)        Shri B.K. Singh, SD/d, RSD, AERB (iv)        Shri G.K. Panda, AERB (v)         Shri Hardeep Singh, Jt.DGFT (vi)        Shri B.K. Sachdeva, Dy.DGFT     The Chairman welcomed the members of the Committee and informed that out of the 24 applications received (till the last meeting held on 14.9.2012) for enlistment of as Pre Shipment Inspection Agency under para 2.32 A of HBP, 3 cases where the applicants have furnished complete information have been approved and public notice to the effect is being issued shortly.  Thereafter, 7 seven new cases have been received till today taking the total to 31 cases.   2.      The Committee also noted that many of the applicants have shown intended area of operation in various European  Countries.    Since,  European  Union  has  27  member  states  which  are  located  primarily  in  Europe,  the Committee decided that EU as a whole will be considered for PSIA in such cases.   3.      The Committee was also informed that in the last meeting it was discussed that some of the applicants are not a member of any of the Organisation (ISRI/IFIA/ISRI/BIR) as prescribed in Col. 3 of P.N. No.104 dated 23.3.2012.

nformed that in the last meeting it was discussed that some of the applicants are not a member of any of the Organisation (ISRI/IFIA/ISRI/BIR) as prescribed in Col. 3 of P.N. No.104 dated 23.3.2012.  However, all other details regarding equipment held and manpower are complete. The Committee was of the view that  the  condition  of  membership  of  aforesaid  organisation  is  not  giving  any  value  addition  and  not  considering applications  merely  on  this  ground  will  not  be  justified.  The  Committee  after  due  deliberations  decided  that  the condition of   membership of aforesaid organisation shall not be mandatory.

5.      The Committee after due deliberations took following decision in each case:­

Case No.1                    M/s.ELBI Consultancy (India) Pvt. Ltd., Kolkata

                                      01/53/162/95/PSIA/AM13/E­5/IC             The Committee considered the application and noted that the firm has now furnished the information in the proforma prescribed by AERB along with serial number of the equipment. The representatives of AERB informed that the information given by the firm appears to be correct. The Committee also noted that the intended are of operations for issuance of certificate has been given by the firm as Kolkata (India).   2.      The Committee after due deliberations decided to approve M/s.ELBI Consultancy (India) Pvt. Ltd., Kolkata as Pre­Shipment Inspection Agency for territory as India.

Case No.2                             M/s.Worldwide Inspection Services Pvt. Ltd., Delhi

                                      01/53/162/161/AM13/W­2/IC             The Committee considered the application and noted that no Show Cause Notice has been issued to this firm.    The  representative  of  AERB  informed  that  the  applicant  has  stated  that  they  do  not  have  mandatory spectrometer, but ready to purchase it if they are approved as PSIA.  Other details furnished by the applicant appear to be correct.      2.      The Committee after due deliberations decided to approve M/s.Worldwide Inspection Services Pvt. Ltd., Delhi as  Pre­Shipment  Inspection  Agency  for  6  countries  subject  to  production  of  proof  of  having  purchased  the mandatory spectrometer within a period of 60 days.

Case No.3                    M/s.Worldwise Inspection Service­SARL, Senegal

                                      West Africa [F.No.01/53/162/AM13/W­3/IC]             The Committee considered the application and noted that a Show Cause Notice has been issued to the firm. The firm has also furnished their reply as well as informed in the proforma prescribed by AERB indicating Serial number of the equipments.  The representatives of AERB informed that the information of the equipments and other technical parameters appears to be in order.  The Committee after due deliberations decided to defer the case for finalising the SCN.

Case No.4                    M/s.Worldwise Inspection Service­SARL, Benin [01/53/162/168/AM13/W­4/IC]                       The  representative  of  AERB  informed  that  the  applicant  has  stated  that  they  do  not  have  mandatory spectrometer, but ready to purchase it if they are approved as PSIA.  Details of other machines and their serial numbers are appears to be correct.    2.      The Committee after due deliberations decided to approve M/s.Worldwide Inspection Services Pvt. Ltd., Delhi as Pre­Shipment Inspection Agency for Benin subject to production of proof of having purchased the mandatory spectrometer within a period of 60 days.

Case No.5                   M/s.Cayley Aerospace Inc., USA

                                      F.No.01/53/162/140/AM13/C­8/IC                                                 that  the  information  given  by  the  firm  appears  to  be  correct.  However,  they  are  having  only  one  Radio  Nuclear Identifier and they have shown intended are of operation in four countries.     2.      The Committee after due deliberations decided to approve M/s. Cayley Aerospace Inc., USA as Pre­Shipment Inspection Agency for territory as USA.

Case No.6                    M/s.Gattini & Co., Mumbai

                                      01/53/162/138/AM13/G­6/IC                                                           The Committee considered the application as per agenda and noted that the applicant was asked to furnish information in the proforma prescribed by AERB. However, they have not furnished the reply.   The Committee, therefore, decided to defer the case for want of information from the firm.

Case No.7                    M/s.Alex Stewart (International) Corporation Ltd.,       Latvija [01/53/162/138/AM13/G­6/IC]                                                           The Committee noted that the case was already approved in the last meeting and public notice in this regard is going to be issued shortly.     Case No.8                    M/s.Superintendence Company of India (P) Ltd., Kolkata [01/53/276/PSIA/AM13/S­30/IC]             The Committee considered the application as per agenda and noted that the firm has furnished photographs of  the  equipments  and  also  indicated  the  serial  number  of  the  testing  equipment.    The  representative  of  AERB informed that the applicant is having two Radio Nuclear Identifier and intended area of operations for issuance of certificate  has  been  shown  in  seven  countries  and  therefore,  the  applicant  should  have  more  Radio  Nuclear Identifiers. They also do not have hand held radiation survey meter which is required for pre shipment inspection.

Case No.9                    M/s.NQAQSR North America, USA 01/53/162/298/AM13/N­8/PSAI/IC

Case No.10                  M/s.A.G. Associates, Mumbai

The Committee noted that this case has already been rejected in the last meeting on the ground that the applicant does not have any mandatory testing equipment for testing metal scrap and also they are not a member of any  of  the  Organisation  prescribed  in  Col.  3  of  P.N.  No.104  dated  23.3.2012.    They  have  also  not  furnished information as per the proforma prescribed by AERB.              Case No.11                             M/s.Ravi Energie Pvt. Ltd,. Baroda 01/53/162/366/AM13/R­13/IC             The Committee noted that the case was already approved in the last meeting and public notice in this regard is going to be issued shortly.

Case No.12                             M/s.SGNCO (UK) Ltd., London 01/53/162/617/AM13/PSIA/S­52/IC

Case No.19                  M/s.Baltic Control Ltd., Denmark

01/53/162/438/AM13/B­13/PSIA/IC   proforma prescribed by AERB along with serial number of the equipment and the other technical information given by the firm appears to be correct. The Committee also noted that the intended area of operations for issuance of certificate has been indicated in more than 125 countries.    2.      The Committee after due deliberations decided to approve M/s.Baltic Control Ltd., Denmark as Pre­Shipment Inspection Agency for territory as Denmark. For other countries, the firm need to furnish clarification as to how they will manage inspection with the available equipments.

Case No.20                  M/s.Nectar Inspection Services L.L.C., Dubai

01/53/162/387/AM13/N­11/PSIA/IC   that they are having two Radio Nuclear Identifier and hence it would be sufficient for inspection at two places only.  The other technical information given by the firm appears to be correct. The Committee also noted that the intended area of operations for issuance of certificate has been indicated as UAE, Canada, USA, India, South Africa, China, Netherlands, Turkey etc.   2.      The Committee after due deliberations decided to approve M/s.Nectar Inspection Services L.L.C., Dubai as Pre­Shipment  Inspection  Agency  for  two  territories,  one  at  UAE  and  for  2nd  territory,  the  applicant  will  give  their preference.   Case No.21                  M/s.Best Mulyankan Consultants Ltd., Mumbai 01/53/162/442/AM13/B­14/PSAI/IC                       The  Committee  considered  the  application  and  noted  that  the  firm  has  furnished  the  information  in  the proforma prescribed by AERB along with serial number of the equipment. From the list of equipment, it seems that they do not have Radio Nuclear Identifier which is crucial equipment for inspection.      2.      The Committee after due deliberations decided to defer the case for want of information from the firm regarding Radio Nuclear Identifier.     Case No.22                             M/s.Sandeep Garg & Co., Gurgaon 01/53/162/560/AM13/PSIA/S­46/IC   that they are having one Spectrometer and 10 Radio Nuclear Identifier and hence it would be sufficient for inspection

2.            The  Committee  after  due  deliberations  decided  to  approve  M/s.Sandeep  Garg  &  Co.,  Gurgaon  as  Pre­ Shipment Inspection Agency for two territories, one at Gurgaon (India) and for other territory, the applicant should specify the country and how they will inspect with limited equipments.

Case No.23                             M/s.Alex Stewart International (Aust) Pty. Ltd

01/53/162/769/PSIA/AM13/G­22/IC             The Committee considered the application as per agenda and noted that the applicant has not furnished information in the proforma prescribed by AERB.

Case No.26                             M/s.V.K. Metcast P Ltd., Delhi

              The Committee considered the issue raised by the applicant and after deliberations decided that no action is required at present.

Case No.27                             M/s.World Wide Logistic Survey &

Inspection (WLSI) Group & Affiliates, Saket,                                                  New Delhi 01/53/162/776/PSIA/AM13/G­23/IC             The Committee considered the application and noted that a Show Cause Notice has been issued to the firm. However, no reply has been received from the firm.  The Committee, therefore, decided to defer the case for want of information from the firm.
