MINUTES OF THE 2nd INTER MINISTERIAL COMMITTEE MEETING CONSTITUTED FOR RECOGNITION AND REVIEW OF PRE­SHIPMENT INSPECTION AGENCY UNDER APPENDIX 5 OF HBP (Vol.­I).   Date           :         14.09.2012 Venue        :         Room No.8, Udyog Bhawan, New Delhi Time           :         2.30 p.m.   Members present:   (i)           Shri D.K. Singh, IAS, Addl.DGFT (ii)          Shri Sushil Kumar, AGM (RINL), Min. of Steel (iii)        Dr. A.U. Sonawane, Head, RSD, AERB (iv)        Shri B.K. Singh, SD/d, RSD, AERB (v)         Shri Hardeep Singh, Jt.DGFT (vi)        Shri B.K. Sachdeva, Dy.DGFT (vii)      Shri D.C. Katoch, FTDO   The Chairman welcomed the members of the Committee and informed that the till date we have received 24 applications for enlistment of as Pre Shipment Inspection Agency under para 2.32 A of HBP.   2.      The representative of AERB informed that radiation survey meters play an important role in monitoring metal scrap.    Similarly,  once  a  radioactive  source  is  discovered,  the  radiation  spectrometers  play  an  important  role  in identification  of  the  source.    From  the  various  applications  received  in  the  office  for  qualification  of  pre­shipment inspection  agencies,  it  has  been  observed  that  most  of  the  applicant  has  not  indicated  the  serial  number  of  the mandatory testing equipment / machinery for testing metal scrap.  Therefore, all the applicants may be requested to furnish  the  detail  in  the  questionnaire  indicating  serial  number  of  the  machines,  as  early  as  possible  for  further

ing metal scrap.  Therefore, all the applicants may be requested to furnish  the  detail  in  the  questionnaire  indicating  serial  number  of  the  machines,  as  early  as  possible  for  further consideration of the applications.    3.      The Committee noted that as per para 2 of the P.N. No.104 dated 23.3.2012, the existing agencies currently listed in Appendix 5 will continue to be valid for six months from the date of this Notification.  Hence, the existing agencies are valid till 22.9.2012 only. No new applicant has been recognized as PSIA as yet for want of information from  them.    Therefore,  there  is  a  need  to  recognise  some  agencies  as  PSIA  whose  details  are  complete expeditiously so that the work relating to issuance of PSIC should not be hampered.

4.      The Committee after due deliberations took following decision in each case. The information not available in file is to be sought from the applicants for further consideration of cases.

Case No.1                    M/s.ELBI Consultancy (India) Pvt. Ltd., Kolkata

                                      01/53/162/95/PSIA/AM13/E­5/IC             The Committee considered the application and noted that the firm has not furnished the following information:­   (i)           Information sought from the firm on 1.8.2012 has not been received. (ii)          They have not indicated serial number of the testing equipments. (iii)        The intended area of operation for issuance of certificate has been indicated as Kolkata and they have not given the address of branch office from where the Inspection of the imported consignment will be carried out by them.  Therefore, how and where they would inspect the consignment abroad.   The Committee after due deliberations decided to defer the case. The firm may be asked to furnish the above information to this Directorate by E Mail as well as to AERB at their e mail bksingh@aerb.gov.in for which e mail has been sent to the firm on 18.9.2012.

Case No.2                             M/s.Worldwide Inspection Services Pvt. Ltd., Delhi

                                      01/53/162/161/AM13/W­2/IC             The Committee considered the application and noted that a Show Cause Notice has been issued to the firm as  per  the  report  received  from  Office  of  the  Commissioner  of  Customs,    Kandla,  Gujarat  where  M/s.Worldwide Inspection Services Pvt. Ltd., Delhi have issued PSIC.  However, their reply is awaited.  Further, they have not given the serial number of the testing equipment.   2.      The Committee also noted that the applicant has not signed the applicant at the prescribed place and they may be asked to sign the application.   3.      The Committee accordingly decided to defer the case for want of said information from the applicant and for getting signature.

Case No.3                    M/s.Worldwise Inspection Service­SARL, Sengal

                                      West Africa [F.No.01/53/162/AM13/W­3/IC]             The Committee considered the application and noted that a Show Cause Notice has been issued to the firm as per the report received from Office of the Commissioner of Customs,  Kandla, Gujarat that some war material have been found in the consignment for which M/s.Worldwise Inspection Service­SARL, Sengal have issued PSIC.  However, their reply is awaited.  Further, they have not given the serial number of the testing equipment.   2.      The Committee also noted that the applicant has not signed the applicant at the prescribed place and they may be asked to sign the application.   3.      The Committee accordingly decided to defer the case for want of said information from the applicant and for getting signature, for which e mail has been sent to the firm on 18.9.2012.     Case No.4                    M/s.Worldwise Inspection Service­SARL, Cotonou, Benin [01/53/162/168/AM13/W­4/IC]                       The  Committee  considered  the  application  and  that  the  applicant  has  not  signed  the  applicant  at  the prescribed place and they may be asked to visit this Directorate for signing the application. Moreover, they have also not given the serial number of the testing equipment.   2.  The Committee accordingly decided to defer the case for want of information from the applicant, for which e mail has been sent to the firm on 18.9.2012.

Case No.5                   M/s.Cayley Aerospace Inc., USA

                                      F.No.01/53/162/140/AM13/C­8/IC                                                           The Committee considered the application and pointed out following deficiencies:­

(1)         The Committee noted that the firm is not a member of any of the Organisation prescribed in Col. 3 of P.N. No.104 dated 23.3.2012.  (2)         They have only one manpower for the purpose of carrying out inspection which may not be sufficient. (3)         They have not furnished copy of annual report / Balance Sheet.  (4)         Information in the proforma, prescribed by AERB.   The applicant may be asked to furnish above information / clarification in order to process their case further.

Case No.6                    M/s.Gattini & Co., Mumbai

                                      01/53/162/138/AM13/G­6/IC                                                           The Committee considered the application and pointed out following deficiencies:­   (1)         The firm is not a member of any of the Organisation prescribed in Col. 3 of P.N. No.104 dated 23.3.2012.  (2)                 They  do  not  have  the  mandatory  testing  equipment  i.e.  Radio  Nuclear  Identifier  which  is  very  crucial equipment for identifying Radio Nuclear presence in the scrap  (3)         The intended are of operation for issuance of certificate has been indicated as Mumbai and they have not given the address of branch office from where the Inspection of imported consignment will be carried out by them.  (4)                  The  firm  has  shown  experience  in  metal  inspection,  though  they  were  not  recognised  as  PSIA.  The Committee, therefore, decided to seek explanation. (5)         Information in the proforma, prescribed by AERB has not been received from them.   The applicant may be asked to furnish above information / clarification in order to process their case further.       Case No.7                    M/s.Alex Stewart (International) Corporation Ltd.,       Latvija [01/53/162/138/AM13/G­6/IC]                                                           The Committee considered the application noted that the applicant has furnished the information in the

2.      The Committee after due deliberations decided to approve M/s.Alex Stewart (International) Corporation Ltd., Latvija as Pre­Shipment Inspection Agency.   Case No.8                    M/s.Superintendence Company of India (P) Ltd., Kolkata [01/53/276/PSIA/AM13/S­30/IC]             The Committee considered the application as per agenda. The representative of AERB informed that the firm has indicated the serial number of the testing equipment.  However, photographs of 7 equipments listed in para 2.1 of the application are required to verify the equipment actually in possession of the applicant.   2.  The Committee, therefore, decided that applicant may be asked to provide photographs of these equipment to this Directorate as well as to AERB by E Mail for which e mail has been sent to the firm on 18.9.2012. On receipt of the mail, the AERB shall confirm the equipments and recommend whether it is a fit case for enlistment.

Case No.9                    M/s.NQAQSR North America, USA 01/53/162/298/AM13/N­8/PSAI/IC

            The Committee considered the application as per agenda and noted that the applicant was asked to furnish information in the proforma prescribed by AERB. However, they have no furnished the reply.    The Committee, therefore, decided to defer the case for want of information from the firm for which e mail has been sent to the firm on 18.9.2012. .

Case No.10                  M/s.A.G. Associates, Mumbai

[01/53/8/302/AM13/A­22/PSIA/IC]             The Committee considered the application as per agenda and noted that the applicant does not have any mandatory testing equipment for testing metal scrap and also they are not a member of any of the Organisation prescribed in Col. 3 of P.N. No.104 dated 23.3.2012.  They have also not furnished information as per the proforma prescribed by AERB.

The Committee after due deliberations decided to reject the case.   Case No.11                             M/s.Ravi Energie Pvt. Ltd,. Baroda 01/53/162/366/AM13/R­13/IC             The Committee considered the application noted that the applicant has furnished the information in the proforma prescribed by AERB along with serial number of the machines. The representative of AERB stated that they are satisfied with the list of equipment in possession by the applicant and it is a fit case for enlistment.   2.            The  Committee  after  due  deliberations  decided  to  approve  M/s.Ravi  Energie  Pvt.  Ltd,.  Baroda  as  Pre­ Shipment Inspection Agency.

Case No.12                             M/s.SGNCO (UK) Ltd., London 01/53/162/617/AM13/PSIA/S­52/IC

            The Committee considered the application as per agenda.  The representative of AERB informed that Radio Nuclear Identifier is mandatory testing equipment for metal scrap.  However, the applicant has indicated “N.A.” in their  application  against  Radio  Nuclear  Identifier.  Further,  they  have  not  indicated  serial  numbers  of  the  testing equipment.   The Committee after due deliberations decided to defer the case for want of (i) confirmation from the applicant whether they are having mandatory Radio Nuclear Identifier in their possession or not and (ii) serial number of the testing equipments.   The applicant may be asked to provide information to this Directorate as well as to AERB by E Mail for which e mail has been sent to the firm on 18.9.2012.

Case No.13                             M/s.Sandeep Garg & Co., USA 01/53/162/616/AM13/PSIA/S­51/IC

            The Committee considered the application as per agenda.  The representative of AERB informed that Radio Nuclear Identifier is mandatory testing equipment for metal scrap.  However, the applicant has indicated “N.A.” in their  application  against  Radio  Nuclear  Identifier.  Further,  they  have  not  indicated  serial  numbers  of  the  testing equipment.

The Committee after due deliberations decided to defer the case for want of (i) confirmation from the applicant whether they are having mandatory Radio Nuclear Identifier in their possession or not and (ii) serial number of the testing equipments.   The applicant may be asked to provide information to this Directorate as well as to AERB by E Mail for which e mail has been sent to the firm on 18.9.2012.

Case No.14                             M/s.Sandeep Garg & Co., Mali 01/53/162/615/AM13/PSIA/S­50/IC

            The Committee considered the application as per agenda.  The representative of AERB informed that Radio Nuclear Identifier is mandatory testing equipment for metal scrap.  However, the applicant has indicated “N.A.” in their  application  against  Radio  Nuclear  Identifier.  Further,  they  have  not  indicated  serial  numbers  of  the  testing equipment.   The Committee after due deliberations decided to defer the case for want of (i) confirmation from the applicant whether they are having mandatory Radio Nuclear Identifier in their possession or not and (ii) serial number of the testing equipments.   The applicant may be asked to provide information to this Directorate as well as to AERB by E Mail for which e mail has been sent to the firm on 18.9.2012.       Case No.14                             M/s.Sandeep Garg & Co, Canada 01/53/162/614/AM13/PSIA/S­49/IC             The Committee considered the application as per agenda.  The representative of AERB informed that Radio Nuclear Identifier is mandatory testing equipment for metal scrap.  However, the applicant has indicated “N.A.” in their  application  against  Radio  Nuclear  Identifier.  Further,  they  have  not  indicated  serial  numbers  of  the  testing equipment.   The Committee after due deliberations decided to defer the case for want of (i) confirmation from the applicant whether they are having mandatory Radio Nuclear Identifier in their possession or not and (ii) serial number of the

Case No.16                             M/s.Nippon Kaiji Kentel Kyokai, Japan 01/53/162/623/AM13/PSIA/N­21/IC             The Committee considered the application noted that the applicant is an existing PSIA and has furnished the information in the proforma prescribed by AERB along with serial number of the machines. The representative of AERB stated that they are satisfied with the list of equipment in possession by the applicant and it is a fit case for enlistment. The Committee also noted that the applicant is not a member of any of the organisation as prescribed in Col. 3 of the application.   2.      The Committee after due deliberations decided to approve the case for enlistment as PSIA subject to reply from the applicant to the effect that they are member of any organisation recognised by Government of Japan / India in connection with Metal Scrap.     Case No.17                  M/s.TUV Rheinland India Pvt. Ltd., Bangalore 01/53/162/564/T­14AM13/PSAI/IC             The Committee considered the application as per agenda and noted that the applicant was asked to furnish information in the proforma prescribed by AERB. However, they have no furnished the reply.

Case No.19                  M/s.Baltic Control Ltd., Denmark

01/53/162/438/AM13/B­13/PSIA/IC             The Committee considered the application as per agenda and noted that the applicant has not furnished Serial Number of the testing equipment for testing metal scrap. They have also not given the list of country in which these

detectors are in the possession of the firm.    The Committee, therefore, decided that the applicant may be asked to provide the above information to this Directorate as well as to AERB by E Mail to take a decision in the matter.

Case No.20                  M/s.Nectar Inspection Services L.L.C., Dubai

Case No.24                             M/s.Humber Inspection International Ltd.,UK

01/53/162/685/AM13/H­18/IC                       The  Committee  considered  the  application  noted  that  the  applicant  has  been  requested  to  furnish  the information in the proforma prescribed by AERB along with serial number of the machines. Moreover, the applicant does not have mandatory Radio Nuclear Identifier which is crucial equipment for identifying radio nuclear presence in the scrap.    2.            The  Committee  after  due  deliberations  decided  that  the  firm  may  be  asked  to  furnish  above  details  / clarification in order to process their case further.   4.      The Chairman concluded the discussions informing the participants that the next meeting will be held on 26th September 2012 at 10.30 a.m.             The meeting ended with vote of thanks to the Chair.   ­x­x­x­
