I. Export obligation period be extended by six months in continuation i.e. upto 30.09.2005. It is for regularisation of exports made after expiry of initial obligation period.
II. This is subject to a payment of composition fee @ 0.5% on unfulfilled FOB value of export made outside the EOP.
III. The minimum value addition of 15% as prescribed under Para 4.09 of FTP (2015-2020) shall be maintained.

Decision:

The Committee noted that last date of shipment in this case is within 18 months from the date of import of first consignment, against the earliest issued Authorisation. Therefore, decided the following:

I. Clubbing of 3 Advance Authorizations as referred above be allowed. II. Exports made against subsequent authorizations but within 18 months from the date of import of first consignment i.e. upto 31.03.2013, against the earliest issued authorization shall only be taken into account for clubbing of authorizations. This will be subject to payment of composition fee @ 0.5% on FOB value of export made beyond 12 months from the first import consignment. III. RA shall examine the case in terms of Para 4.09 of FTP and ensure value addition of minimum 15%. The 15% value addition for evaluating entitlement is to be applied on the entire FOB and CIF of the authorizations to be clubbed.

Decision:

The Committee noted that last date of shipment in this case is within 12 months from the date of import of first consignment, against the earliest issued Authorisation. Therefore, decided the following:

Decision:

The committee noted that the PRC in its meeting No40/AM dated 11.03.2014 has allowed clubbing of above referred 4 Advance Authorisations, taking into consideration the facts that the RA had issued EODC / waiver of bond against three Authorisations issued in the year 2009. However, RA has reported that the LUT executed by the applicant with the Customs Authority for import of inputs has been cancelled. Thus, it cannot be treated the case of waiver of bond. Therefore, RA did not allow clubbing of said Authorisations. After detailed discussion, it was opined that while granting waiver of bond/EODC, RA has allowed pro-rata enhancement in quantity and value of the Authorisations, which permitted the Authorisation holder to further import goods, hence it cannot be a case of redemption because after redemption no exports and imports are allowed. The committee, therefore, directed RA to adhere to the decision of PRC dated 11.03.2014.

0310608036 dated 27.12.2010.

Decision:

The committee noted that the PRC in its meeting No40/AM dated 11.03.2014 has allowed clubbing of above referred 4 Advance Authorisations, taking into consideration the facts that the RA had issued EODC / waiver of bond against three Authorisations issued in the year 2009. However, RA has reported that the LUT executed by the applicant with the Customs Authority for import of inputs has been cancelled. Thus, it cannot be treated the case of waiver of bond. Therefore, RA did not allow clubbing of said Authorisations. Decision:

The Committee observed that Authorisation No 0210200167 dated 18.02.2014 is issued having initial export obligation period of 18 months. Whereas other all Authorisations have been issued having initial obligation period of 36 months. Further, Authorisation dated 18.02.2014 has been issued after a gap of 36 months from the date of issue of earliest issued Authorisation thus, the same cannot be allowed to be clubbed with Authorisation issued in the year 2010. The committee, therefore, did not accede to the request and directed to get the cases regularized individually in terms of Para 4.28 of HBP 2009-2014.

(Action: RA, Kolkata - If the party fails to get the case regularized in terms of Para 4.28 of HBP within a month from the date of communication of this decision, RA shall take action against the firm under the provision of FT (D&R) Act. 1992 and submit an Action Taken Report).

Case No.14.M/s PKPN Shinning Mills (P) Ltd., Coimbatore

Subject: - Request for EOP extension of 2 Advance Authorization No. 3210048040 dated

18.05.2011 and 3210058674 dated 19.11.2012 regularization purposes.

Decision:

The committee noted that the applicant has fulfilled 100% export obligation within 48th month and 30th months respectively from the date of issue of Authorisations. Hence decided as follows.

  1. Extension in EOP upto 30.05.2015 be allowed against two Authorisations.
  2. This will be subject to payment of composition fee @ 0.5% of FOB value of exports made after 36th month/ 18th month but up to 42nd month /24th month and @ 0.5% per months of FOB value of exports made from 43rd month upto 48th month and from 25th month upto 30th month respectively, from the date of issue of Authorisations.
  3. Minimum 15% VA shall be maintained. Shortfall in value addition, if any, shall be regularised in terms of Para 4.28 of HBP 2009-2014.

The committee noted that the PRC in its meeting dated 07.07.2015 has allowed extension in export obligation period by 3 months from the date of endorsement

subject to condition that 50% exports have been completed within 12 months period as prescribed. The applicant has requested to delete the condition No III and V that is composition fee @ 0.5% of FOB value and 50% exports completion within initial obligation period. The committee, after detailed discussion, agreed to delete the 50% export condition, as the same is being imposed in case extension is sought against Advance Authorisation. In this case, export obligation period of 12 months is imposed as per condition of ITC HS No 44071010. Thus, this 50% exports completion condition is deleted. However, request for composition fee waiver is rejected.
