Subject: Revalidation of Advance Authorisation No. 0310434582 dt. 29.06.2007.

  The Committee noted that the export obligation fulfilled in respect of aforesaid Advance licence was 100% Qty.­wise and 100% value­wise within valid EO period, as claimed by the firm, and accordingly the Committee decided to revalidate the aforesaid advance authorization for a period of six months from the date of communication of the decision of PRC as per the provisions of FTP, subject to payment of composition fee @ 1% of the unutilized cif value of the authorization and also subject to verification by RA of EO fulfillment status, as claimed by the firm. RA is directed to examine the case in terms of Public Notice No. 23 dated 4.12.2009 and make necessary endorsements regarding value addition of minimum 15% or as stipulated in the authorization whichever is higher at the time of revalidation.

        The Committee noted that EO fulfilled against aforesaid Advance Authorization was more than 50% both Qty.­wise and value­wise within valid EOP, as claimed by the firm. Therefore, the Committee decided to extend EOP, against the aforesaid advance authorization, for a period of six months from the date of communication of the decision of PRC, subject to verification by RA of EO claimed to have been fulfilled by the firm within the valid EOP and also subject to payment of composition fee @ 6% of the duty saved amount for the balance inputs in proportion to export obligation beyond export obligation period.  RA is directed to examine the case in terms of Public Notice No.  23 dated 4.12.2009 and make necessary endorsements at the time of EOP extension.

  The Committee noted that the export obligation fulfilled in respect of aforesaid Advance licence was 100% Qty.­wise and 101.57% value­wise within valid EO period, as claimed by the firm, and accordingly the Committee decided to revalidate the aforesaid advance authorization for a period of six months from the date of communication of the decision of PRC as per the provisions of FTP, subject to payment of composition fee @ 1% of the unutilized cif value of the authorization and also subject to verification by RA of EO fulfillment status, as claimed by the firm. RA is directed to examine the case in terms of Public Notice No. 23 dated 4.12.2009 and make necessary endorsements regarding value addition of minimum 15% or as stipulated in the authorization whichever is higher at the time of revalidation.

  The Committee noted that EO fulfilled against aforesaid Advance Authorization was more than 50% both Qty.­wise and value­wise within valid EOP, as claimed by the firm. Therefore, the Committee decided to extend EOP, against the aforesaid advance authorization, for a period of six months upto 30.9.2009 for the purpose of closure and regularsation, subject to verification by RA of EO claimed to have been fulfilled by the firm within the valid EOP and also subject to payment of composition fee @ 6% of the duty saved amount for the balance inputs in proportion to export obligation beyond the valid export obligation period.  RA is directed to examine the case in terms of Public Notice No.  23 dated 4.12.2009 and make necessary endorsements at the time of EOP extension.

Subject: Request for change of category from “Private” to “Passenger”

  The Committee noted that M/s. Jaiprakash Associates Ltd. Lucknow was granted import licence for import of Aircraft for Private Use with actual user condition on the recommendation of DGCA.  The Committee also noted that DGCA vide their letter dated 9.12.2009 has given no objection for using aircraft in ‘passenger’ category in place of private category. In view of the aforesaid recommendations PRC decided to allow the request of the applicant firm in relaxation of actual user condition from Private use to Passenger cateogy.

Case No. 22:  M/s Microsynth Fabrics (India) Ltd., Mumbai.

Subject: Revalidation of Advance Licence No. 0310396504 dt. 25.08.2006.

Subject: Request for import of 6 KOMATSU HM 300­2R Off Road Articulated Dump Truck Vehicles.

  Committee considered the request of the firm and decided to permit import of 6 KOMATSU HM 300­2R Off Road Articulated Dump Truck Vehicles in relaxation of ILN 7 condition of TAC/COP, subject to the condition that the vehicles will not ply on the road.

Case No. 24:  M/s Halliburton, Mumbai.

Subject: Request for relaxation in ILN 1 of chapter 87.

  Committee considered the request of the firm and decided to permit import of Special Oil Field Equipment for the use of various oil and gas fields in India in relaxation of para (1) (ii) of ILN of chapter 87 subject to the condition that the vehicles will be kept off the highways. Trailer will be re­exported after completion of the contract and that the same would not ply on public road.   Case No. 25:  Audit Objection – regarding TED refund by Office of the Jt. DGFT, Jaipur to M/s Man Structural Ltd. and M/s Pyrotech Electronics Ltd. when Policy provides for exemption from payment of TED. File No. 01/92/180/41/AM11/PC­VI

Subject: Request for relaxation in ILN 1 of chapter 87.

  The  Committee discussed the case and noted that basically supplies covered under Para 8.2(d) and 8.2(g) are to be effected without Terminal Excise Duty.  Para 8.3 (c) of FTP enables such supplies to be affected without payment of TED ab­initio if the supplies are under ICB. JDGFT Jaipur has informed that these supplies are otherwise entitled for deemed export benefit but instead of supplying without payment of TED, supplies have been effected on payment of TED and refund has been claimed. After considering all pros and cons the Committee decided to relax provision of paragraph of 8.3(c) of FTP and regularized the refund already made by the o/o JDGFT Jaipur as there is no revenue implications in supplying without payment of duty ab­initio or paying TED first and then taking refund. Committee also took note of the fact that PRC has provided relaxation in such cases in past as well.

Scrip No Date of Issue Date of Expiry CIF Value Unutilized value 0510216067 8.2.2008 8.2.2010 71,39,623/­ 69,45,853/­   The Committee discussed the matter at length and the following decision was taken: The Committee considered the fact that there is an economic slowdown and accordingly decided to take a lenient view to revalidate the SFIS scrip No. 0510216067 dated 8.2.2008 for six months from the date of endorsement on the SFIS scrip with a deduction of 5% of balance unutilized value of the duty credit scrip. However, the applicant to approach RA immediately within the next 15 days of communication of PRC decision and RA shall endorse the revalidation of SFIS Scrip No. 0510216067 dated 8.2.2008 within a maximum of 7 days thereafter.

File No. 01/53/8/162/Misc/P­16/AM11 Subject: Request to allow Duty Free import of Rough Granite Blocks against Advance Authorization No. 0710068043 dated 5.11.2009 issued on self­declared basis for manufacture and export of granite slabs.   The Committee noted that the firm M/s. Pat International were issued an Advance licence dated 5.11.2009 on self declared basis under Paragraph 4.7 of HBP v.1.  It also observed that though there is no SION available for the import of rough granite, there was no restriction to import rough granite block under paragraph 4.7 (adhoc norm basis) of paragraph 4.7 of HBP v.1. It also noted that the firm had already imported a part of the consignment and completed part export obligation against the said licence. In view of  this fact and the fact that the import of rough granite has now been disallowed even under paragraph 4.7 of HBP v.1 vide Public Notice No. 83 dated 22.7.2010, the committee decided to allow import of rough granite against advance licence no. 0710068043 dated 5.11.09 issued to the firm under self declared basis and accordingly allowed ex­post facto approval of the action taken in this regard by this Directorate.

File No. 01/53/162/00047/AM­09/S­4/Import Cell Subject: Request of M/s. Shyama Shyam Dham Samity, Vrindavan, to allow shifting of 500 MTs. of scrap and 200 MTs of left over crack rough marble blocks to their another temple project in Barsana, Mathura.               The committee noted that M/s. Shyama Shyam Dham Samity was granted an import licence no. 0650000161 dated 18.1.2010 (subject to actual user condition) for import of 2000 MTs of rough marble blocks from Italy for construction of their temple (Prem Mandir) at Vrindavan.  Committee also noted the request of the applicant to allow shifting of the scrap (so generated while constructing the Prem Mandir at Vrindavan) and the leftover crack rough marble blocks to their another temple project site at Barsana, Mathura.   Committee observed that “rough marble” is restricted for import and is allowed only against an import licence & is subject to actual user condition. After detailed deliberation and the fact that the request is to transfer to their project site at Barsana, Mathura, the committee agreed to the request of the applicant  to allow transfer of the 500 MTs. of scrap and 200 MTs of left over crack rough marble blocks  to their site at Mathura for construction of another temple at  “Barsana Temple”.
