Case No.1:   Uppal Properties (P) Ltd.

F. No. 01/36/218/20/AM07/EPCG.I Meeting No: 1/08   Date:  24­5­07 Subject Relaxation from the requirement of Homologation certificate  for cars  imported    under  EPCG  Scheme  and  release  of  Bank

Guarantee by customs.             Committee observed that policy as on date, provides exemption from homologation criterion in respect of imported cars with Engine capacity of 3000 CC  (Petrol) and CIF value of US$ 40,000 or more. The case has come up before the committee for relaxation as imports  have  taken  place  before  this  provision  of  exemption  was  put  in  place.  Committee  further  noted  that  RA  has  already  issued EODC. It was therefore decided to examine the matter on file for seeking C&IM’s approval.  This  is  subject  to  production  of  type approval certificate by the applicant from the country of manufacture.

Case No.2:  Exempler Nihon Spindle Mfg. Co. Pvt. Ltd., Mumbai

F. No.01/80/162/474/AM07/DES.I Subject Revalidation  of  advance  licence  No.0310243312  dated 22.12.2003.             Committee observed that the Regional Authority is empowered to allow revalidation with a total validity period of 30 months from the date of issue of licence /Authorisation. In the instant case, the licence is stated to have been issued in December 2003 which would mean that the 30 months period available to the applicant for utilizing the licence expired in June 2006. The Committee considered that the firm had applied in reasonable time frame for submission of request for revalidation.  Moreover, taking into account the fact that the applicant had fulfilled the EO as detailed in the Agenda,  “No Bond Certificate” has already been issued by RA, Mumbai and the licence could not be utilised because of firm being in DEL list, committee decided that a lenient view should be taken to enable the applicant to replenish the stocks. Taking these factors into consideration, it was decided in relaxation of the policy provision, to allow revalidation in the instant case for a period of 6 months and this 6 months period will commence from the date of endorsement to this effect,  made on the licence. This will further be subject to the condition that (i)                applicant pays the composition fee equivalent to 2% of the unutilized CIF value of the licence; (ii)              applicant approaches the Regional Authority concerned within a period of 15 days from the date of issue of communication

Case No.3:   Exempler Nihon Spindle Mfg. Co. Pvt. Ltd., Mumbai

Case No.4:  Ole Fine Organics Ltd., Mumbai

F. No.01/83/50/1221/AM03/DES.IV Subject Revalidation of advance licence No.0310180605 dated 27.01.2003   Committee noted from the agenda that EO had been fulfilled.  Balance import item i.e. stearic acid could not be imported in time because of delay by ALC in amendment of the said item.  Hence, Committee decided to revalidate the advance licence for six months from endorsement date subject to payment of 2% Composition fee of cif value of unutilized licence.  The applicant would approach the Regional Authority concerned within a period of 15 days from the date of issue of communication regarding decision of the PRC for seeking endorsement of revalidation.

Case No.5:  Ole Fine Organics Ltd., Mumbai

F. No.01/83/162/792/AM06/DES.IV Subject Revalidation of advance licence No.0310180036 dated 23.10.2003

Committee observed that the Regional Authority is empowered to allow revalidation with a total validity period of 30 months from the date of issue of licence/Authorisation. In the instant case the licence is stated to have been issued in October 2003 which would mean that the 30 months period available to the applicant for utilizing the licence expired in April 2006. The Committee considered that the firm had applied in reasonable time frame for submission of request for revalidation.  Moreover, taking into account the fact that the applicant had fulfilled the EO as detailed in the Agenda, there was delay in issuance of EODC by RA Mumbai.  A lenient view should be taken to enable the applicant to replenish the stocks. Taking these factors into consideration, it was decided in relaxation of the policy provision, to allow revalidation in the instant case for a period of 6 months and this 6 months period will commence from the date of endorsement to this effect,  made on the licence. This will further be subject to the condition that (i) the applicant pays the composition fee equivalent to 2% of the unutilized CIF value of the licence; (ii) the applicant approaches the Regional Authority concerned within a period of 15 days from the date of issue of communication regarding decision of the PRC for seeking endorsement of revalidation.

Case No.6:  Aurbindo Pharma Pvt. Ltd.,Hyderabad

F. No.01/87/162/323/AM07/DES.VIII Subject Extension  in  EOP  under  Advance  Licence  No.0910013320  dated 11.03.2003   Imports  under  advance  licence  scheme  is  subject  to  actual  user  condition.  In  this  case,  Committee  observed  that  as  per  DRI Report, licensee had violated actual user conditions of advance licence by diverting finished product made out of imported input into domestic market prior to completion of exports.  Accordingly, the Committee decided to reject the request for EOP extension.

Case No.7:   Aurbindo Pharma Pvt. Ltd.,Hyderabad

F. No.01/87/162/324/AM07/DES.VIII Subject Extension  in  EOP  under  Advance  Licence  No.0910015641  dated 3.9.2003   Imports  under  advance  licence  scheme  is  subject  to  actual  user  condition.  In  this  case,  Committee  observed  that  as  per  DRI Report, licensee had violated actual user conditions of advance licence by diverting finished product made out of imported input into domestic market prior to completion of exports.  Accordingly, the Committee decided to reject the request for EOP extension.

F. No.01/53/8/58/E­5/AM05/ILS Subject Permission  for  disposal  of  one  used  imported  Bell  helicopter 1997 Model Marking Registration No.VT­YAY   Committee noted that Essar Steel / Essar Investments have floated Futura Travels Ltd, another company.  While permission for acquisition of one aircraft has already been accorded, here same Directors are desirous of selling off the existing aircraft although it was acquired only 2 years back.   Committee arrived at a conclusion that given actual user condition, the rationale for such changes need to be ascertained and clarified.  Committee further noted that in their second application by Futura Travels, details of users have already been asked before permitting the request.

Case No.8 B:  Essar Steel Ltd., Mumbai

Case No.9:  Jindal Steel & Power Ltd., New Delhi

Subject Permission for conversion of category of aircraft from private to Passenger   Committee noted the request of the firm and decided that possibility of any other private aircraft owners and its impact needs to be assessed before this comes up for reconsideration for policy relaxation to convert the category of aircraft from Private to Passenger.

Case No.10:  Vital Health Care

F. No.01/82/50/44/AM03/DES­III Subject Waiver of 2% composition fee against revalidation of  Advance Licence No.0310175477 dated 31.12.2003   Committee noted that earlier GRC decided on 17­7­2006 in favour of applicant based on change of Norms effected vide PN No. 58 dated  12­4­04.  Committee  observed  the  rationale  of  GRC  decision  and  accordingly  accorded  ex­post­facto  approval  for  waiver  of composition fee against revalidation of the advance licence.

Case No.11:  Indian Steel & Allied Product, Chennai

F. No.01/80/162/737/AM07/DES.I Subject Revalidation  of  Advance  Licence  No.0410053798  dated 01.03.2004   Committee observed that the Regional Authority is empowered to allow revalidation with a total validity period of 30 months from the date of issue of licence /Authorisation. In the instant case the licence is stated to have been issued in March, 2004 which would mean that the 30 months period available to the applicant for utilizing the licence expired in September, 2006. The Committee considered that the firm had applied in reasonable time frame for submission of request for revalidation.  Committee further observed the fact that the applicant had fulfilled the EO as detailed in the Agenda.  However, it was observed that there was delay of 11 months in issuance of EODC by RA, Chennai.  Therefore, Committee decided to defer the case for seeking satisfactory explanation of delay from RA, Chennai.

Case No.12:  Rational Art & Press Pvt.Ltd., Mumbai

F. No.01/93/180/053/AM.07/PC.I (B) Subject Relaxation of Policy Provision for waiver of the Type Approval Certificate for the import of Toyota vehicle Land Cruiser Cygnus V8 Car   Committee noted that Department of Heavy Industry had disagreed with the firm’s request to allow waiver from the type approval certificate.  Accordingly the Committee decided to reject the request of the firm.

Case No.13: GMR Industries Ltd., Bangalore

F. No.01/53/8/350/G­34/AM06/ILS Subject Permission for conversion of category of aircraft from Private to Passenger ( Public Category).   Committee noted the request of the firm and decided that possibility of any other private aircraft owners and its impact needs to be assessed before this comes up for reconsideration for policy relaxation to convert the category of aircraft from Private to Passenger. Accordingly the matter was deferred.

Case No.14: Focus Energy Ltd., New Delhi

F. No.01/93/180/010/AM.07/PC.I (B) Subject Relaxation in Provisions of Para 2(II) of Import Licensing Notes  to Chapter 87 of ITC(HS) for clearance of 5 Seismic Vibrators required for  seismic  survey  to  explore    existence  of  Oil  /  Gas  in  Block  RJ­ ONN­2003/02 in Jaisalmer District, Rajasthan.              Committee noted that in this case, the Department of Heavy Industry have recommended for relaxation of the policy provision.   Committee further noted that in this case, Seismic Vibrators would be mounted on Motor Vehicle. Accordingly, relaxation of Licensing

Notes (subject to condition that Vibrators mounted on vehicle would be used for stated purpose and same should be re­exported after project completion) was recommended by the Committee.

Case No.15:  National  Centre for Cell Science, Pune

F. No.01/53/162/1370/AM07/N­38/ILS Subject Request for grant of revalidation of Import Licence No.3150000152 dated 08.06.2004 for six months upto 30.06.2007 beyond the original validity of 30 months.   Committee noted that the Institute could not import the balance quantity of Mice / Rats in time, which was required for R & D purpose.  Committee note that there is no harm in allowing revalidation of the import licence in the present case being for R&D purpose and accordingly decided to allow revalidation for 6 months for import of balance Nos. of Live Mice / Rats for research purpose.

Case No.16:  Armour Polymers Ltd., Mumbai

F. No.01/87/162/641/AM06/DES.VIII Subject Revalidation of 8 advance licences   Committee noted that GRC had recommended for revalidation of 8 advance licences pertaining to the period 1995­2001.   It was also noted that PRC referred back on 22­11­06 to GRC for reconsideration of its earlier decision.  Subsequently GRC had communicated that C&IM had approved for revalidation of these licences.  Accordingly, the Committee decided that revalidation may be done with the approval of DG on file.

Case No.17:  National Leather Cloth Manufacturing Company, Mumbai

F. No.01/87/162/507/AM05/DES.VIII Subject Grant of extension in EOP under 12 Advance Licenses issued during the year  AM  1997­98  for  a  period  of  12  months  without  payment  of

composition fee   Committee  noted  that  GRC  had  recommended  for  extension  of  EOP  for  12  advance  licences  pertaining  to  1997–1998.    PRC referred  back  the  matter  to  GRC  on  22­11­06  with  its  reservation  on  the  GRC  decision    for  reconsideration.    Subsequently,  GRC communicated  that  EOP  extension  had  the  approval  of  C&IM.    Accordingly,  Committee  decided  to  allow  EOP  extension  with  the approval of DG on file.

Case No.18:  M/s. Sirocco Pressings Pvt. Ltd.

F. No.01/92/180/10/AM07/PC.II Subject Relaxation  of  time  period  for  applying  for  refund  of  Terminal Excise (TED)  ( Para 9.3. of Handbook)   Committee noted that details of the value of pending TED Refund along with other details were not available in the Agenda.  So, to arrive at a final decision, it was decided that Quantum of refund involved along with relevant dates would be required.  Accordingly, it was decided that the matter might be put up to D.G. in file with full details by the concerned Division for taking a final decision.

Case No.19:  M/s. Fine Organics Industries, Mumbai

F. No.01/83/162/791/AM06/DES.IV Subject Revalidation of Licence No.0310202251 dated 19.05.2003   Committee observed that the Regional Authority is empowered to allow revalidation with a total validity period of 30 months from the date of issue of licence/Authorisation. In the instant case the licence is stated to have been issued in May 2003, which would mean that the 30 months period available to the applicant for utilizing the licence expired in November, 2005. The Committee observed that the firm applied for EODC to RA Mumbai on 30­9­05 but the EODC was issued by RA only on 16­11­05, after a delay of 30 days excluding the processing time.  The Committee further considered that the firm had applied in  reasonable time frame for submission of request for revalidation to DGFT Hqrs.  Moreover, taking into account the fact that the applicant had fulfilled the EO as detailed in the Agenda and there was delay of one month in issuance of EODC by RA Mumbai,  a lenient view should be taken to enable the applicant to replenish the stocks. Taking these factors into consideration, it was decided in relaxation of the policy provision, to allow revalidation in the instant

Case No.20:  M/s  Mauria Udyog Ltd.

F. No.01/94/180/65 (pt.B)/AM06/PC.I Subject DFCE benefit to applicant irrespective of fact that BRC contains name of M/s Flex Engineering Ltd. also – relaxation of condition of third party exports.   Committee observed that the matter was recommended by GRC earlier.  It also noted that the applicant being assignee of contract and 97% of  realisation was in favour of applicant with only 3% commission attributed to M/s Flex Engineering Ltd.  Accordingly, Committee accorded ex­post­facto approval of the relaxation allowed to the firm.

F. No.01/82/162/07/DES.III Subject Revalidation of Advance licences beyond 30 months   Committee observed that the Regional Authority is empowered to allow revalidation with a total validity period of 30 months from the date of issue of licence/Authorisation. In the instant case, three advance licences are stated to have issued in May 2003, July 2003 and September, 2003, which would mean that the 30 months period available to the applicant for utilization of these licences expired in November 2005, January 2006 and March 2006 respectively.   The applicant firm applied for revalidation beyond the original 18 months validity period to RA on 22­7­05, 16­9­05 and 15­9­05 respectively.  RA could not revalidate the licence because of misplacement of documents. The Committee decided to defer the case for seeking satisfactory explanation from RA Kolkata.

Case No.22:  M/s. Spectra Fashions

F. No.01/84/162/784/AM07/DES.V Subject EOP  extension  against  advance  licence  No.0210061758  dated 05.03.2004   Committee observed that the Regional Authority is empowered to allow EOP extension with a total validity period of 30 months from the date of issue of licence/Authorisation. In the instant case the licence is stated to have been issued in March, 2004 which would mean that the 30 months period available to the applicant for fulfillment of E.O. expired in September, 2006.   It was also noted from the Agenda that the applicant could not complete export obligation within EOP because of non­acceptance of consignment by foreign buyer.  Accordingly,  Committee  decided  to  extend  EOP  for  6  months  i.e.  upto  5­3­2007,  subject  to  payment  of  composition  fee  @  5%  for unutilized material (over and above 2% / 5% already payable for preceding 6 months).

Case No.24:  Yamuna Industries Ltd.

F. No.01/92/180/374/AM06/PCII Subject Request for extension of period for adjustment of Advance DTA sale permission for another 6 months till March 2007.   The Committee noted that the officer dealing with the subject matter could not attend the meeting.  So, it was decided to defer the case.

Case No.25:  Hindustan Aeronautics Ltd., Bangalore

F. No.01/80/162/750/AM07/DES.I Subject Request for grant of extension in EOP against advance  licence No.0710025788 dated 8.12.2003   Committee observed that the Regional Authority is empowered to allow EOP extension with a total validity period of 30 months from the date of issue of licence /Authorisation. In the instant case the licence is stated to have been issued in December, 2003 which would mean that the 30 months period available to the applicant for utilizing the licence expired in June, 2006.  Committee further noted that E.O could not be fulfilled in time due to technical problems faced in manufacture of export product i.e., High Precision Aluminium Forgings for Aircraft applications. Accordingly, the Committee decided to extend EOP for a period of six months subject to payment of 5% composition fee for unutilized material (over and above 2% / 5% already payable for preceding 6 months).
