APM Terminals India Pvt. Ltd. - Annex CFS located at Block 5-18, Sector -6, Dronagiri Warehousing Complex, Navi Mumbai Maharashtra 400 707 was appointed as ‘Custodian’ and Customs Cargo Service Provider under Section 45 of the Customs Act, 1962 vide Notification No. 12/2009 dated 01.07.2009 and later renewed from time to time and vide earlier Notification No. 21/2010 dated 15.03. 2015 and then renewed for period of five years vide Public Notice No. 102/2020 dated 17.08.2020. 2. Now, in exercise of the powers conferred on me under Section 45(1) and 141 (2) of the Customs Act, 1962, I, D. S. Garbyal, Commissioner of Customs (General), JNCH, hereby renew the appointment of M/s. APM Terminals India Pvt. Ltd. - Annex CFS as 'Custodian' of the imported goods received at the Container Freight Station M/s. APM Terminals India Pvt. Ltd. - Annex CFS until these are cleared for home consumption or are warehoused or disposed or are transshipped in accordance with the provisions of the Customs Act, 1962.Similarly, M/s. APM Terminals India Pvt. Ltd. - Annex CFS will also be the 'Custodian' of the Export Cargo brought into said Container Freight Station, for examination and stuffing till their exportation through Jawaharlal Nehru Port.

3. Further, in exercise of the powers conferred on me under Regulation 10 of the ' Handling of Cargo in Customs Areas Regulations 2009", I, D. S. Garbyal, Commissioner of Customs (General), JNCH, hereby renew the approval of M/s. APM Terminals India Pvt. Ltd. - Annex CFS as the ‘Customs Cargo Services Provider' for the said CFS M/s. APM Terminals India Pvt. Ltd. - Annex CFS subject to the following conditions:

(i) The Custodian M/s. APM Terminals India Pvt. Ltd. - Annex CFS approved as ‘Customs Cargo Services Provider’ for the said CFS shall abide by all the provisions of the Customs Act, 1962, the 'Handling of Cargo in Customs Areas Regulations, 2009', and other rules, regulations, notifications, orders issued there under. (ii) The duration of appointment of M/s. APM Terminals India Pvt. Ltd. - Annex CFS as Custodian and as 'Customs Cargo Services Provider" shall remain valid for till 09.08.2028 i.e. till it has been granted as AEO status. If the validity of AEO status granted to the CFS is withdrawn prior to the scheduled date i.e. 09.08.2028 or is not extended beyond 09.08.2028, the CFS is required to seek permission from the Commissioner of Customs (General), JNCH to act as Custodian.

(iii) The waiver from execution of Bank Guarantee has been given in terms of regulation 5(3) of HCCAR, 2009, as the CFS has been accredited with AEO-LO status, with validity till 09.08.2028. If the validity of AEO status granted to the CFS is withdrawn prior to the scheduled date i.e. 09.08.2028 or is not extended beyond 09.08.2028, the CFS shall execute bank guarantee for the amount, as determined, w.e.f. date of expiry of validity of AEO status.

(iv) The Commissioner of Customs (General), JNCH, shall have the Right to review the approvalfailure as ‘Customs Cargo Services Provider’ before the completionof five years for to comply with any of Regulations of the 'Handling of Cargo in Customs Areas Regulations, 2009' or as per the directions of the Government of India.
